Present for the Board of Appeals and attending the meeting were: Bill Rossi, Chair, Peter Knight, Chris Murphy, Wendy Weldon and Chuck Hodgkinson. Absent were Barbara Armstrong, Frank LoRusso, Rodney Bunker and Michael Halbreich. Also present: Laurel Wilkinson (for Egger), Roland Kluver (for Liebowitz) and Carly Look (for Poritz).
Mr. Rossi opened the meeting at 7:00 PM.
LAUREL WILKINSON DISCUSSION FOR DAVID EGGER: As a follow up to the November 8 Special Permit approval Laurel Wilkinson presented a revised plan dated November 17, 2005 for the deck extension that added a planting bed below the deck level to raise the soil grade and reduce the distance from the deck to the ground. A motion to approve the minor changes was made, seconded and unanimously approved.
MINUTES: The November 8, 2005 minutes were reviewed. A motion to approve the minutes with minor changes was made, seconded and unanimously approved.
ROLAND KLUVER FOR MICHAEL & SHARON LIEBOWITZ: Mr. Rossi opened the public hearing at 7:10 PM. Mr. Kluver summarized the history of this project from its approval in November 2004 to today. Several changes were made to the approved plans to remodel this historic house in the Middle Road Roadside District. These changes were not reviewed with the Building Inspector prior to construction. The Building Inspector instructed Mr. Kluver to stop construction and apply for a second Special Permit for the changes.
Mr. Kluver brought special attention to the added kitchen window and dormer and the arched entrance way with trellises on the east side and how the north end of the building extension was squared off versus the original design. This added ten square feet to the footprint. He also provided several pictures of houses in West Chop that have similar rounded cottage archways.
The Board discussed at length the specific by-law (Article 11 Section 11.6C2a) and whether or not they felt the changes were consistent with the architectural style of the existing house. The Board concluded the changes were not significantly different than the style of the house. A motion to accept the changes as presented and dated 12/13/05 was made seconded and unanimously approved.
JIM FUHRER FOR MIDDLETON, FEUERSTEIN, EDDY AND BERLIN: Mr. Rossi opened the public hearing at 7:25 PM. Mr. Fuhrer was not able to attend the hearing. A motion to continue the hearing to January 10, 2006 @ 7:40 PM was made, seconded and unanimously approved.
CARLY LOOK FOR ALAN AND DEBORAH PORITZ: Mr. Rossi opened the public hearing at 7:40 PM. Ms. Look summarized the plans for a built–in swimming pool and separate equipment shed. She added that a two-car garage with a bedroom and bath above would also be added after the pool construction is completed. A Special Permit is not necessary for the garage as it meets all zoning by-law specifications. With no further discussion a motion to approve the plans as presented with the conditions that the pool will comply with all of Chilmark’s swimming pool requirements and the Fire Chief will approve the standpipe location was made, seconded and unanimously approved.
COTTON POOL DISCUSSION: Mr. Rossi read a letter aloud from abutter Steve Schwab dated 11/9/05 claiming the required screening has not been installed -- as conditioned in the Special Permit approval for the Cotton’s pool. Mr. Rossi added he has since received a second letter stating a great deal of progress had been made. Ms. Look summarized her discussions with Mr. Schwab and agreed to continue to work with Mr. Schwab and hoped to plant additional screening this spring.
FISCAL YEAR 2007 BUDGET: A draft budget for FY 2007 was reviewed and unanimously approved by the Board.
